Can You Really Go to Jail for Using the Identity Theft Method When It's Fake?



What's can happen if you file a 🤖 f͟a͟l͟s͟e͟ ͟p͟o͟l͟i͟c͟e͟ ͟r͟e͟p͟o͟r͟t͟, affidavit and say that you're a victim of identity theft when you're 😈 𝗿𝗲𝗮𝗹𝗹𝘆 𝗻𝗼𝘁?
Well, let's look at 🔎 𝗣𝗲𝗻𝗮𝗹 𝗖𝗼𝗱𝗲 𝟭𝟰𝟴.𝟱 𝗣𝗖, which is the California statute that makes it 💡 ͟i͟l͟l͟e͟g͟a͟l͟ ͟t͟o͟ ͟m͟a͟k͟e͟ ͟a͟ ͟f͟a͟l͟s͟e͟ ͟p͟o͟l͟i͟c͟e͟ ͟r͟e͟p͟o͟r͟t͟ ͟o͟f͟ ͟a͟ ͟c͟r͟i͟m͟e͟. The report could be of a misdemeanor or a felony offense. It states that "every person who reports to any peace office... the A͟t͟t͟o͟r͟n͟e͟y͟ ͟G͟e͟n͟e͟r͟a͟l͟, or a deputy attorney general, or a district attorney, or a deputy district attorney general, or a district attorney that a felony or misdemeanor has been committed, knowing report to be false, is guilty of a misdemeanor."

⛔͟ ͟A͟ ͟v͟i͟o͟l͟a͟t͟i͟o͟n͟ ͟w͟o͟u͟l͟d͟ ͟b͟e͟ ͟p͟u͟n͟i͟s͟h͟a͟b͟l͟e͟ ͟b͟y͟ ͟c͟o͟u͟n͟t͟y͟ ͟j͟a͟i͟l͟ ͟f͟o͟r͟ ͟u͟p͟ ͟t͟o͟ ͟s͟i͟x͟ ͟m͟o͟n͟t͟h͟s͟.͟.͟.͟

What this means is that if you're sending out letters to the credit bureaus claiming that you're a victim of identity theft when it isn't true, multiple adverse actions can take place against you:
1. You can become part of the criminal justice system because you thought it was okay to commit fraud and do 6 months in jail
2. The creditors will not want to give you credit because they'll see you as a liability, regardless of whether you're a victim or not
3. The credit bureaus can possibly block your ability to dispute your negative items because you can't first state that you're a victim of identity theft and then go and state that they actually belong to you
4. If you DO get deletions, they will be temporary. Once they come back on because they actually belonged to you, section 611 (that states a reinserted item must be removed if they don't notify you within 5 days) does not apply due to the fraudulent dispute and they'll be near-impossible to get off!

A letter must be constructed a very specific way, using the facts extracted directly from the credit report to support your claim of inaccuracy.

3 Resons why you should wait to apply for new credit

Applying for new credit before all derogatory items are deleted: My advice to my clients is always the same: wait until you're done with your credit repair or credit sweep program, but have a strategy to move forward from there.
